\u00cen orice comunitate un rol important \u00eel joac\u0103 starea societ\u0103\u021bii civile \u0219i activitatea ei pentru protec\u021bia drepturilor \u0219i libert\u0103\u021bilor omului. Numai o societate civil\u0103 dezvoltat\u0103 \u00ee\u0219i poate permite un astfel de lucru, o societate \u00een care dezvoltarea economic\u0103, cultural\u0103, juridic\u0103 \u0219i politic\u0103 are loc printre membrii s\u0103i. Societatea civil\u0103 este acea parte a societ\u0103\u021bii care se implic\u0103 \u00een crearea unei baze materiale a vie\u021bii, ea a existat \u00eentotdeauna \u0219i se remarc\u0103 prin raport cu statul specializat \u00een management. \u00centr-o astfel de societate, se asigur\u0103 libertatea de exprimare, inclusiv libertatea de critic\u0103, publicitatea, accesul la diferite tipuri de informa\u021bii, dreptul la circula\u021bie liber\u0103, cooperare cultural\u0103 \u0219i \u0219tiin\u021bific\u0103 cu state str\u0103ine \u0219i organiza\u021bii publice. Societatea civil\u0103 se caracterizeaz\u0103 prin existen\u021ba diverselor forme \u0219i institu\u021bii sociale (sindicate, partide, asocia\u021bii de afaceri, societ\u0103\u021bi de consum, cluburi etc.) care pot exprima \u0219i realiza cele mai diverse nevoi \u0219i interese ale persoanei. \u00cen Transnistria, aceste institu\u021bii sunt create \u0219i exist\u0103 sub forma Federa\u021biei Sindicatelor, Camera de Comer\u021b, Uniunea Industria\u0219ilor \u0219i Agricultorilor, Camera Public\u0103 a Transnistriei, Institutul Comisarului pentru Drepturile Omului, Uniunea Comunit\u0103\u021bilor ruse\u0219ti, moldovene\u0219ti \u0219i ucrainene, dou\u0103 partide politice mai active \u0219i altele, dar o serie din enumera\u021bii reprezentan\u021bi ai societ\u0103\u021bii civile nu sunt capabili s\u0103 realizeze \u00een mod independent interesele membrilor lor \u0219i ale societ\u0103\u021bii \u00een ansamblu. \u00centr-o mare m\u0103sur\u0103, motivul este c\u0103 autorit\u0103\u021bile transnistrene au un control destul de rigid asupra activit\u0103\u021bii acestor organiza\u021bii. \u00cen ciuda faptului c\u0103 fiecare dintre reprezentan\u021bii societ\u0103\u021bii civile ar trebui s\u0103 desf\u0103\u0219oare activit\u0103\u021bi pe baza principiilor umaniste recunoscute universal. Principalele caracteristici ale unei astfel de societ\u0103\u021bi sunt libertatea economic\u0103, politic\u0103 \u0219i spiritual\u0103 a individului. Principalul semn politic al societ\u0103\u021bii civile este func\u021bionarea unui stat de drept \u00eentr-o astfel de societate, \u00een care statul de drept este o parte integrant\u0103 a societ\u0103\u021bii civile. Statul de drept, de fapt, este rezultatul dezvolt\u0103rii societ\u0103\u021bii civile \u0219i condi\u021bia \u00eembun\u0103t\u0103\u021birii acesteia. Economiile din aceste fonduri au r\u0103mas la Chi\u0219in\u0103u \u0219i nu a revenit \u00een regiune sub form\u0103 de construc\u021bie a centrelor de s\u0103n\u0103tate, tabere de pionier, cre\u0219terea num\u0103rului de vouchere pentru sanatorii, a c\u0103ror num\u0103r nu a crescut nici \u00een ultimii ani. Deducerile \u00een propor\u021bie de 50-35% din bugetul sindical au fost cheltuite, \u00een principiu, pe \u00eentre\u021binerea dispozitivului mare de muncitori al Consiliului Sindicatelor din Moldova. Principala nemul\u021bumire este cauzat\u0103 de lipsa unei pozi\u021bii a sindicatelor din cadrul RSSM pentru a proteja interesele zonale ale lucr\u0103torilor: adoptarea unor legi discriminatorii privind func\u021bionarea limbilor, \u00eenc\u0103lcarea drepturilor lucr\u0103torilor la munc\u0103 din cauza ignor\u0103rii limbii moldovene\u0219ti.<\/span><\/p>\n

S-a spus c\u0103 exprimarea voin\u021bei \u0219i dorin\u021bei maselor muncitoare de a-\u0219i consolida eforturile \u0219i ac\u021biunile \u00een contextul aprofund\u0103rii proceselor de transformare economic\u0103, de re\u00eennoire democratic\u0103 a societ\u0103\u021bii, con\u0219tientiz\u00e2nd de responsabilitatea sindicatelor pentru protec\u021bia drepturilor \u0219i intereselor sociale ale muncitorilor, Congresul constitu\u021bional al sindicatelor din Transnistria a declarat formarea FEDERA\u021aIEI UNIUNILOR PROFESIONALE ALE TRANSNISTRIEI.<\/span><\/p>\n

Structura sindical\u0103 este cea mai mare \u00een organiza\u021biile publice din Transnistria \u0219i include o multitudine de organiza\u021bii sindicale pe diferite niveluri: – asocia\u021bia sindicatelor\u00a0 educa\u021biei publice \u0219i \u0219tiin\u021bei; – asocia\u021bia sindicatelor lucr\u0103torilor din domeniul s\u0103n\u0103t\u0103\u021bii; – asocia\u021bia sindicatului lucr\u0103torilor economiei republicane, locale \u0219i transportului; – asocia\u021bia sindicatelor lucr\u0103torilor din domeniul agriculturii \u0219i industriei prelucr\u0103toare; – asocia\u021bia a sindicatului angaja\u021bilor institu\u021biilor de stat \u0219i a serviciilor publice; – sindicatul lucr\u0103torilor din domeniul culturii \u0219i sportului; – sindicatul unificat al structurilor de putere\/securitate din Transnistria. Cea mai mic\u0103 unitate structural\u0103 este organiza\u021bia sindical\u0103 primar\u0103, care este \u00eenfiin\u021bat\u0103 \u00een fiecare \u0219coal\u0103, gr\u0103dini\u021b\u0103 \u0219i alte organiza\u021bii de stat. Dar, de mult timp, organiza\u021biile primare \u0219i-au pierdut pozi\u021biile \u00een cadrul organiza\u021biilor comerciale, ceea ce este foarte d\u0103un\u0103tor pentru cei care lucreaz\u0103 pentru antreprenorii din Transnistria \u00een ceea ce prive\u0219te protejarea drepturilor \u0219i intereselor lor legitime.<\/span><\/p>\n

Sindicatul se declar\u0103 ca o organiza\u021bie independent\u0103 fa\u021b\u0103 de organele de stat \u0219i structurile economice, politice \u0219i sociale, ele nu sunt responsabile \u0219i nu pot fi controlate, dar \u00een Transnistria, din p\u0103cate, nu este a\u0219a.<\/span><\/p>\n

Membrii acestei organiza\u021bii publice \u00een\u021beleg prin scopul cre\u0103rii – solu\u021bionarea celor mai importante problemele: – salariile sc\u0103zute ale popula\u021biei active; – respectarea timpului de lucru \u0219i a timpului de odihn\u0103; – legalitatea amenzilor aplicate lucr\u0103torilor impuse de administrarea \u00eentreprinderilor pentru diferite \u00eenc\u0103lc\u0103ri; – acumularea corect\u0103 a pensiilor; – organizarea \u00een siguran\u021b\u0103 a procesului de produc\u021bie \u0219i a lucr\u0103rilor.<\/span><\/p>\n

Angajatorul, f\u0103r\u0103 a crea o structur\u0103 sindical\u0103 la \u00eentreprindere, r\u0103m\u00e2ne cu problemele protec\u021biei sociale a angajatului \u00een conformitate cu legisla\u021bia actual\u0103 transnistrean\u0103. Astfel, \u00een cazul cre\u0103rii a organiza\u021biilor pentru drepturile omului \u00een Transnistria, care permit angajatului s\u0103 se adreseze instan\u021bei pentru protec\u021bia drepturilor sale profesionale, el las\u0103 angajatorul \u00eentr-o situa\u021bie de pierdere, deoarece legisla\u021bia Transnistria impune respectarea strict\u0103 a tuturor normelor de drept al muncii care nu sunt pe deplin respectate \u00een sfera afacerilor mici \u0219i mijlocii din Transnistria. Pe de alt\u0103 parte, Federa\u021bia Sindicatelor \u00een sine nu este \u00een m\u0103sur\u0103 s\u0103 se prezinte angajatorului Transnistriei ca partener social, care este capabil s\u0103 ajute cu problemele care apar, at\u00e2t \u00een \u200b\u200bvia\u021ba social\u0103 c\u00e2t \u0219i \u00een sectorul industrial. Angajatorul este interesat \u00een activitatea sindicatelor \u00a0\u00een condi\u021biile ca acesta s\u0103 asigure la locul de munc\u0103 reducerea accidentelor de munc\u0103 \u0219i, \u00een consecin\u021b\u0103, reducerea costurilor de eliminare a consecin\u021belor accidentelor \u0219i incidentelor, pentru \u00eenc\u0103lcarea disciplinei muncii conform legisla\u021biei Transnistriei.<\/span><\/p>\n

Federa\u021bia Sindicatelor din Transnistria (FST) este o institu\u021bie economic\u0103 a societ\u0103\u021bii care reprezint\u0103 \u0219i protejeaz\u0103 drepturile, libert\u0103\u021bile \u0219i interesele sociale, economice \u0219i de munc\u0103 ale membrilor sindicatelor. FST particip\u0103 la adoptarea deciziilor manageriale la toate nivelurile, \u00een alegerile deputa\u021bilor; invoc\u0103 cereri de modificare, anulare, suspendare a ac\u021biunilor luate de hot\u0103r\u00e2ri, care contravin legisla\u021biei actuale \u0219i normelor general recunoscute ale dreptului interna\u021bional sau care \u00eencalc\u0103 interesele membrilor sindicatelor; coordoneaz activit\u0103\u021bile organiza\u021biilor membre.<\/span><\/p>\n

Folosind dreptul consfin\u021bit \u00een Constitu\u021bia Transnistriei (articolul 72), Federa\u021bia Sindicatelor din Transnistria particip\u0103 la toate etapele procesului legislativ. Prin introducerea unor modific\u0103ri la legisla\u021bia actual\u0103, ea \u00eencearc\u0103 s\u0103 o reformeze \u00een interesul oamenilor muncii \u0219i introduce, de asemenea, noi ini\u021biative legislative. Federa\u021bia Sindicatelor proceseaz\u0103 \u00a0toate ini\u021biativele legislative, care provin de la Sovietul Suprem. \u00cen condi\u021biile de criz\u0103 din ultimii ani, exist\u0103 o nevoie tot mai mare de monitorizare a respect\u0103rii legisla\u021biei muncii cu reduceri for\u021bate. Aceast\u0103 structur\u0103 social\u0103 este singura, care are dreptul de ini\u021biativ\u0103 legislativ\u0103 \u00een Sovietul Suprem al Transnistriei, ceea ce \u00eei confer\u0103 puteri mai largi pentru a proteja drepturile lucr\u0103torilor \u0219i a interveni prompt \u00een schimb\u0103rile legisla\u021biei din direc\u021bia \u00eembun\u0103t\u0103\u021birii pozi\u021biei angajatului, dar \u00a0cu aceast\u0103 ini\u021biativ\u0103 FST nu se folose\u0219te des, iar propunerile\u00a0 nu au un caracter reformator.<\/span><\/p>\n

Totul este frumos declarat pe h\u00e2rtie \u0219i \u00een discursurile liderilor mi\u0219c\u0103rilor sindicale din Transnistria, dar at\u00e2t muncitorii c\u00e2t \u0219i organiza\u021biile sindicale primare se confrunt\u0103 cu o serie de probleme care nu sunt solu\u021bionate de FST. Lu\u00e2nd, ca exemplu, o institu\u021bie de \u00eenv\u0103\u021b\u0103m\u00e2nt, unde tinerii tot mai pu\u021bini vin la \u0219coal\u0103 pentru a lucra. Nu este un secret faptul c\u0103 asigurarea unei performan\u021be mai eficiente a func\u021biilor sindicale \u00een condi\u021biile moderne depinde \u00een mare m\u0103sur\u0103 de abilit\u0103\u021bile \u0219i activit\u0103\u021bile practice ale liderilor care opereaz\u0103 cu sistemul organiza\u021bional sindical. Rolul liderului \u00een organiza\u021bia sindical\u0103 primar\u0103 este deosebit de important, iar preg\u0103tirea unor astfel de lideri nu se \u00eent\u00e2mpl\u0103 ast\u0103zi, pentru c\u0103 sindicatul pur \u0219i simplu nu dispune de mijloace. \u00cen mod similar, sindicatul nu desf\u0103\u0219oar\u0103 activit\u0103\u021bi interna\u021bionale \u0219i nu intr\u0103 \u00een contact cu organiza\u021bii similare din \u021b\u0103rile vecine.<\/span><\/p>\n

Evenimentele legate de deteriorarea situa\u021biei sociale \u0219i economice globale din Transnistria creeaz\u0103 noi sarcini \u00een fa\u021ba sindicatelor, prioritatea \u00een munc\u0103 este capacitatea fiec\u0103rui lucr\u0103tor sindical s\u0103 stabileasc\u0103 un dialog permanent \u0219i constructiv cu angajatorii \u0219i guvernul, s\u0103 ajute la g\u0103sirea de compromisuri \u0219i la atenuarea consecin\u021belor fenomenului de criz\u0103.<\/span><\/p>\n

Dup\u0103 cum putem vedea, lista problemelor nu s-a schimbat prea mult, iar muncitorul este cel care \u0219tie cel mai bine despre toate problemele cu care se confrunt\u0103 \u00een mod constant. Dar, \u201eunul \u00een teren nu este un r\u0103zboinic\u201d \u0219i pentru a-\u0219i ap\u0103ra interesele, muncitorii trebuie s\u0103 se uneasc\u0103. Angajatul trebuie s\u0103 \u00een\u021beleag\u0103 c\u0103, dac\u0103 nu este membru al sindicatului, el este lipsit de ajutorul sindicatului. Dar, problema este c\u0103 sindicatul de ast\u0103zi din Transnistria, \u00een aceast\u0103 form\u0103, nu este capabil s\u0103 rezolve problemele cu care se confrunt\u0103 angajatul.<\/span><\/p>\n

Sindicatul transnistrean nu are viziuni clare cu privire la modul de a face Federa\u021bia \u00a0atractiv\u0103 pentru lucr\u0103torii din toate sectoarele, inclusiv antreprenoriatul, care ar trebui s\u0103 fie motiva\u021bia pentru apartenen\u021ba sindical\u0103, care ar trebui s\u0103 fie baza viitorului sindicatelor, cu alte cuvinte, care sunt perspectivele sindicatelor, cum ar trebuie el s\u0103 fie \u00een urm\u0103torii 5, 10 ani.<\/span><\/p>\n

25 de ani de istorie a ziarului \u201e\u0218tirile Sindicatului\u201d, cel mai interesant cu abordare \u00een protec\u021bia drepturilor \u00een Transnistria pentru libertatea de exprimare, \u0219i-a schimbat direc\u021bia odat\u0103 cu schimbarea \u0219efului ziarului \u201e\u0218itirile Sindicatului\u201d.<\/span><\/p>\n

Ziarul a fost conceput ca un organ al organiza\u021biilor sindicale primare, ca o platform\u0103 pentru discutarea problemelor de actualitate ale vie\u021bii sindicale, o tribun\u0103 pentru schimbul de opinii, de formare sindical\u0103, dialog \u00eentre membrii sindicatelor. Dar, \u00een ultima vreme, ziarul s-a transformat brusc \u00eentr-un instrument politic, mi\u0219carea sindical\u0103 \u00een ziar mai are doar o singur\u0103 pagin\u0103, restul materialelor sunt\u00a0 alese \u00een principal de c\u0103tre \u0219eful redactor Koval Ludmila Mihailovna.<\/span><\/p>\n

Acesta este motivul pentru care conducerea Federa\u021biei Sindicatelor din Transnistria a stabilit o sarcin\u0103 de a rec\u00e2\u0219tiga controlul asupra ziarului, de a stabili mecanisme clare de influen\u021bare a politicii editoriale. Dar, mecanismele legale pentru \u00eentoarcerea Federa\u021biei Sindicatelor la fondatorii ziarului nu exist\u0103. Prezidiul Consiliului FST \u00een unanimitate, a decis s\u0103 refuze formularea \u00een utilizarea cuv\u00e2ntului \u201esindicat\u201d \u0219i a derivatelor acesteia \u00een numele publica\u021biei. Acest lucru a dus la \u00eenchiderea ziarului \u201e\u0218tirile Sindicale\u201d. \u00cen vara anului 2017 Federa\u021bia Sindicatelor, ca subiect al drepturilor legale, a f\u0103cut o modificare la Legea \u201eCu privirea \u00a0sindicatelor, drepturile \u0219i garan\u021biile lor\u201d \u00een Sovietul Suprem.\u00a0 \u00cen consecin\u021b\u0103 \u0219i \u00een conformitate cu aceasta, toate persoanele juridice \u0219i mass-media \u00eenregistrate \u00eenainte de intrarea \u00een vigoare a prezentei legi, ale c\u0103ror nume sau titluri con\u021bin cuv\u00e2ntul \u201esindicat\u201d, precum \u0219i cuvintele derivate din acesta, \u00een termen de 30 de zile calendaristice de la data intr\u0103rii legii, sunt obliga\u021bi s\u0103 trimit\u0103 o adres\u0103 unit\u0103\u021bii interprofesionale republicane a sindicatelor \u00een vederea ob\u021binerii permisiunii de a folosi cuv\u00e2ntul \u201esindicat\u201d, precum \u0219i cuvintele derivate din acesta \u00een numele sau titlul lor. Asocia\u021bia republican\u0103 inter-industrial\u0103 a sindicatelor \u00een termen de treizeci de zile calendaristice de la data primirii contesta\u021biei respective este obligat\u0103 s\u0103 ia decizia de consim\u021b\u0103m\u00e2nt de a folosi cuv\u00e2ntul \u201esindicat\u201d, precum \u0219i cuvintele derivate din acesta \u00een numele persoanei juridice sau \u00een numele mass-media sau s\u0103 refuze s\u0103 \u00a0foloseasc\u0103 \u00een numele persoanei juridice sau \u00een numele mass-media cuv\u00e2ntul \u201esindicat\u201d, precum \u0219i cuvintele derivate din acesta. \u00cen cazul primirii refuzului de a folosi cuv\u00e2ntul \u201esindicat\u201d \u00een numele unei entit\u0103\u021bi juridice sau \u00een numele mass-media, precum \u0219i cuvintele derivate din acesta, ele sunt supuse re\u00eenregistr\u0103rii obligatorii \u00een termen de cel mult 90 de zile calendaristice de la data intr\u0103rii \u00een vigoare a prezentei legi sau de lichidare, dac\u0103 nu se efectueaz\u0103 re\u00eenregistrarea. Aceasta \u00eenseamn\u0103 c\u0103 ziarul \u201e\u0218tirile Sindicatului\u201d, \u201edispare\u201d din domeniul informa\u021bional al Transnistriei, iar la re\u00eenscriere va fi un alt ziar, cu un nume diferit, o alt\u0103 ideologie.<\/span><\/p>\n

Pre\u0219edin\u021bia FST a adoptat decizia de a refuza consiliului de redac\u021bie dreptul de a folosi cuv\u00e2ntul \u201esindicat\u201d \u0219i derivatele acestuia \u00een titlu, semn\u00e2nd astfel ziarul o \u201epedeaps\u0103 cu moarte\u201d.<\/span><\/p>\n

\u201e\u0218tirile Sindicatului\u201d, entit\u0103\u021bi juridice, \u00een numele c\u0103rora sunt prezente cuv\u00e2ntul \u201esindicat\u201d sau derivatele sale, sunt toate organiza\u021biile sindicale republicane, teritoriale, primare care trebuie s\u0103 cear\u0103 \u0219i permisiunea FST. Legea a provocat o reac\u021bie foarte furtunoas\u0103 \u0219i controversat\u0103 \u00eentre membrii sindicatelor \u0219i avoca\u021bilor din Transnistria.<\/span><\/p>\n

\u00cen general, legea adoptat\u0103 de FST este unical\u0103. Nu numai c\u0103, vine \u00een conflict cu Codurile Civile \u0219i de Munc\u0103, chiar \u0219i pentru perioada de timp \u00een care este necesar s\u0103 se efectueze procedura de lichidare, deoarece instituie un monopol privind utilizarea cuv\u00e2ntului \u201esindicat\u201d pentru o organiza\u021bie – este ceva nou \u00een lege. Aceasta \u00eencalc\u0103 Constitu\u021bia \u0219i legea sindical\u0103, care garanteaz\u0103 oamenilor libertatea de a forma sindicate. Mai mult de at\u00e2t, aceasta ofer\u0103 Federa\u021biei\u00a0 \u201ep\u00e2rghii\u201d, care pun la \u00eendoial\u0103 \u00eens\u0103\u0219i ideea \u0219i sensul mi\u0219c\u0103rii sindicale. Se poate spune c\u0103 Sovietul Suprem al Transnistriei a promulgat legea la cererea Federa\u021biei \u0219i c\u0103 legea a fost scris\u0103 sub \u201e\u0218tirile Sindicatului\u201d pentru a sc\u0103pa de ele. De asemenea, FST a refuzat \u0219i federa\u021biei primare a sindicatelor companiei \u201eERES\u201d, probabil pentru c\u0103 organiza\u021bia primar\u0103 a \u201eERES\u201d a intrat \u00een aceast\u0103<\/a> list\u0103 numai pentru c\u0103 a \u00eendr\u0103znit s\u0103 se retrag\u0103 din FST \u0219i s\u0103 devin\u0103 independent\u0103.<\/span><\/p>\n
