Fenomenul dat nu poate fi trecut cu aten\u0163ia, odat\u0103 ce la 25 de ani de la formarea regiunii secesioniste, \u015fi, respectiv, a activit\u0103\u0163ii Chi\u015fin\u0103ului de a dezaproba fenomenul, <span style=\"mso-spacerun: yes;\">\u00a0<\/span>anume ideea separ\u0103rii se accept\u0103, pe c\u00e2nd cea a integr\u0103rii provoac\u0103 probleme promotorilor. Unul din ei a fost \u00een zilele ce s-au scurs Valeriu Li\u0163cai, ex-ministru de externe, care a declarat \u00een cadrul unei conferin\u0163e \u201e\u015ftiin\u0163ifice\u201d la Chi\u015fin\u0103u, c\u0103 v\u00e2ltoarea evenimentelor ar putea amplasa Transnistria \u00een componen\u0163a RM, f\u0103r\u0103 a \u00eentreba societatea respectiv\u0103. La valul de critic\u0103 la adresa fostului \u201eministru\u201d a aderat \u015fi Pre\u015fedintele E. \u015eevciuc, care a evoluat la 07 septembrie 2016 cu un decret<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>cu genericul \u201eReferitor la realizarea totalurilor referendumului republican din 17 septembrie 2006\u201d.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: .0001pt; text-align: justify; line-height: normal; mso-outline-level: 2;\"><span lang=\"RO\" style=\"font-size: 12.0pt; font-family: 'Times New Roman'; mso-ansi-language: RO; mso-fareast-language: RU;\">Astfel, la 10 ani de la efectuarea evenimentului, a ap\u0103rut necesitatea de a impune prin decret realizarea normelor prev\u0103zute de acesta. Putem concluziona c\u0103, \u00een alt mod, \u00een baza deciziilor anterioare, acest lucru nu se \u00eent\u00eempla; ceea ce nicidecum nu \u00eenseamn\u0103 c\u0103 \u015fi acest decret \u00ee\u015fi va atinge scopul. Profit\u0103m de ocazie, pentru a reitera con\u0163inutul fenomenului din 2006, la care din nou se apeleaz\u0103. Pornind de la totalurile referendumului cu privire la rela\u0163iile \u201ermn\u201d cu Federa\u0163ia Rus\u0103 \u015fi Republica Moldova, ce a avut loc la 17 septembrie 2006, \u00een cadrul c\u0103ruia 97.2% din aleg\u0103torii care au participat la vot, s-au pronun\u0163at pentru \u201eindependen\u0163a Transnistriei cu perspectiva liberei ader\u0103ri ai acesteia la Federa\u0163ia Rus\u0103\u201d. O asemenea perspectiv\u0103 (de aderare) a devenit posibil\u0103 ca urmare a Deciziei Dumei de Stat din 6 octombrie 2006 \u201eCu privire la totalurile referendumului transnistrean din 17 septembrie 2006 nr. 3560-4 GD, expediate Pre\u015fedintelui FR, camerei superioare a legislativului din FR, \u00een toate structurile abilitate europene, \u00eentre care \u015fi Parlamentul RM. Astfel, o decizie ilegal\u0103 a unei structuri autoproclamate transnistrene, a fost sus\u0163inut\u0103 \u015fi ridicat\u0103 la nivel de act legitim de c\u0103tre camera inferioar\u0103 a legislativului FR.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>Zece ani \u00een urm\u0103 tentativa a r\u0103mas f\u0103r\u0103 efectele a\u015fteptate. \u015eevciuc evit\u0103 a analiza motivele, din ce cauze rezultatelor referendumului nu s-a dat curs \u015fi procesul de integrare a Transnistriei \u00een spa\u0163iul rusesc nu a cuprins o dinamic\u0103 pozitiv\u0103. El doar constat\u0103 aceast\u0103 stare a lucrurilor \u015fi, prin decret, ordon\u0103 exercitarea altui set de ac\u0163iuni, nu \u00eenainte de a aminti c\u0103 \u201epoporul \u00een \u201eRMN\u201d este purt\u0103torul superior ai puterii statale \u00een regiune, iar referendumul \u2013 forma major\u0103 de exprmare a dolean\u0163elor acestui popor.\u201d <\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: .0001pt; text-align: justify; line-height: normal; mso-outline-level: 2;\"><span lang=\"RO\" style=\"font-size: 12.0pt; font-family: 'Times New Roman'; mso-ansi-language: RO; mso-fareast-language: RU;\">Decretul \u00een mod imperativ indic\u0103: <\/span><\/p>\n<p class=\"ListParagraph\" style=\"margin-bottom: .0001pt; text-align: justify; text-indent: -.25in; line-height: normal; mso-outline-level: 2; mso-list: l0 level1 lfo1;\"><span lang=\"RO\" style=\"font-size: 12.0pt; font-family: 'Times New Roman'; mso-ansi-language: RO; mso-fareast-language: RU;\"><span style=\"mso-list: Ignore;\">1.<span style=\"font: 7.0pt 'Times New Roman';\">\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span><\/span><\/span><span lang=\"RO\" style=\"font-size: 12.0pt; font-family: 'Times New Roman'; mso-ansi-language: RO; mso-fareast-language: RU;\">\u00cen baza rezultatelor referendumului republican a stabili direc\u0163ia de baz\u0103 a politicii interne a \u201erepublicii moldovene\u015fti nistrene\u201d ajustarea sistemului de drept a Transnistriei cu legisla\u0163ia federal\u0103 a Federa\u0163iei Ruse. <\/span><\/p>\n<p class=\"ListParagraph\" style=\"margin-bottom: .0001pt; text-align: justify; text-indent: -.25in; line-height: normal; mso-outline-level: 2; mso-list: l0 level1 lfo1;\"><span lang=\"RO\" style=\"font-size: 12.0pt; font-family: 'Times New Roman'; mso-ansi-language: RO; mso-fareast-language: RU;\"><span style=\"mso-list: Ignore;\">2.<span style=\"font: 7.0pt 'Times New Roman';\">\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span><\/span><\/span><span lang=\"RO\" style=\"font-size: 12.0pt; font-family: 'Times New Roman'; mso-ansi-language: RO; mso-fareast-language: RU;\">Organele puterii din \u201ermn\u201d \u015fi cele locale, vor \u00eendrepta prerogativele \u00een domeniul dreptului \u015fi legisla\u0163iei spre realizarea voin\u0163ei poporului, exprimate \u00een cadrul referendumului &#8211; \u00een special \u00een domeniile financiare, de ocrotire a s\u0103n\u0103t\u0103\u0163ii, instruire etc.<span style=\"mso-spacerun: yes;\">\u00a0\u00a0 <\/span><\/span><\/p>\n<p class=\"ListParagraph\" style=\"margin-bottom: .0001pt; text-align: justify; text-indent: -.25in; line-height: normal; mso-outline-level: 2; mso-list: l0 level1 lfo1;\"><span lang=\"RO\" style=\"font-size: 12.0pt; font-family: 'Times New Roman'; mso-ansi-language: RO; mso-fareast-language: RU;\"><span style=\"mso-list: Ignore;\">3.<span style=\"font: 7.0pt 'Times New Roman';\">\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span><\/span><\/span><span lang=\"RO\" style=\"font-size: 12.0pt; font-family: 'Times New Roman'; mso-ansi-language: RO; mso-fareast-language: RU;\">A stabili c\u0103 principiul de baz\u0103 a procesului de ajustare a legisla\u0163iei \u201ermn\u201d celei din FR este cel a integrit\u0103\u0163ii, \u015fi a exclude inconsecven\u0163a sau selectarea anumitor norme aprobate \u00een republic\u0103.<\/span><\/p>\n<p class=\"ListParagraph\" style=\"margin-bottom: .0001pt; text-align: justify; text-indent: -.25in; line-height: normal; mso-outline-level: 2; mso-list: l0 level1 lfo1;\"><span lang=\"RO\" style=\"font-size: 12.0pt; font-family: 'Times New Roman'; mso-ansi-language: RO; mso-fareast-language: RU;\"><span style=\"mso-list: Ignore;\">4.<span style=\"font: 7.0pt 'Times New Roman';\">\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span><\/span><\/span><span lang=\"RO\" style=\"font-size: 12.0pt; font-family: 'Times New Roman'; mso-ansi-language: RO; mso-fareast-language: RU;\">Actele legislative, care ar contraveni principiilor de baz\u0103 a func\u0163ion\u0103rii rela\u0163iilor de drept \u00een FR, sunt considerate drept contrare voin\u0163ei poporului transnistrean \u015fi nu pot fi exercitate. <\/span><\/p>\n<p class=\"ListParagraph\" style=\"margin-bottom: .0001pt; text-align: justify; text-indent: -.25in; line-height: normal; mso-outline-level: 2; mso-list: l0 level1 lfo1;\"><span lang=\"RO\" style=\"font-size: 12.0pt; font-family: 'Times New Roman'; mso-ansi-language: RO; mso-fareast-language: RU;\"><span style=\"mso-list: Ignore;\">5.<span style=\"font: 7.0pt 'Times New Roman';\">\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span><\/span><\/span><span lang=\"RO\" style=\"font-size: 12.0pt; font-family: 'Times New Roman'; mso-ansi-language: RO; mso-fareast-language: RU;\">Guvernul \u201ermn\u201d, \u00een colaborare cu exper\u0163ii Sovietului Suprem \u015fi a corpului judiciar, \u00een termen de dou\u0103 s\u0103pt\u0103m\u00eeni de la adoptarea decretului, va forma Comisia de Stat pentru ajustarea legisla\u0163iei \u201ermn\u201d la legisla\u0163ia Federa\u0163iei Ruse. Nu mai t\u00eerziu de 1 noiembrie 2016 de prezentat pre\u015fedintelui \u201ermn\u201d planul procesului de ajustare a legisla\u0163iei \u201ermn\u201d celei din FR.<\/span><\/p>\n<p class=\"ListParagraph\" style=\"margin-bottom: .0001pt; text-align: justify; text-indent: -.25in; line-height: normal; mso-outline-level: 2; mso-list: l0 level1 lfo1;\"><span lang=\"RO\" style=\"font-size: 12.0pt; font-family: 'Times New Roman'; mso-ansi-language: RO; mso-fareast-language: RU;\"><span style=\"mso-list: Ignore;\">6.<span style=\"font: 7.0pt 'Times New Roman';\">\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span><\/span><\/span><span lang=\"RO\" style=\"font-size: 12.0pt; font-family: 'Times New Roman'; mso-ansi-language: RO; mso-fareast-language: RU;\">Guvernul \u201ermn\u201d va coordona activitatea organelor executive referitor la ajustarea actelor departamentale cu scopul de a armoniza \u015fi acest domeniu cu legisla\u0163ia din FR.<span style=\"mso-spacerun: yes;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span><\/span><\/p>\n<p class=\"ListParagraph\" style=\"margin-bottom: .0001pt; text-align: justify; text-indent: -.25in; line-height: normal; mso-outline-level: 2; mso-list: l0 level1 lfo1;\"><span lang=\"RO\" style=\"font-size: 12.0pt; font-family: 'Times New Roman'; mso-ansi-language: RO; mso-fareast-language: RU;\"><span style=\"mso-list: Ignore;\">7.<span style=\"font: 7.0pt 'Times New Roman';\">\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span><\/span><\/span><span lang=\"RO\" style=\"font-size: 12.0pt; font-family: 'Times New Roman'; mso-ansi-language: RO; mso-fareast-language: RU;\">Responsabili \u2013 conduc\u0103torii structurilor executive centrale \u015fi locale. Controlul execut\u0103rii decretului \u00eei revine \u201eprimministrului\u201d <span style=\"mso-spacerun: yes;\">\u00a0<\/span>P. Procudin.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: .0001pt; text-align: justify; line-height: normal; mso-outline-level: 2;\"><span lang=\"RO\" style=\"font-size: 12.0pt; font-family: 'Times New Roman'; mso-ansi-language: RO; mso-fareast-language: RU;\">Observatorii \u015fi comentatprii transnistreni, care au misiunea de a demonstra c\u0103 inten\u0163ia este una serioas\u0103 \u015fi cu perspectiv\u0103 de \u00een f\u0103ptuire \u00een via\u0163\u0103, au accentuat la unele momente din con\u0163inutul decretului, consider\u00eend c\u0103 respectarea \u00eentocmai a acestora ar putea face procesul dinamic \u015fi ireversibil. \u00cen primul r\u00eend, este vorba de excluderea inconsecven\u0163ei \u015fi a modului selectiv de ajustare a legisla\u0163iei. Se propune ca \u00een domeniile de baz\u0103 &#8211; cum ar fi financiar, economic, impozitar, vamal &#8211; legisla\u0163ia s\u0103 fie adoptat\u0103 integral \u015fi primordial. Actele normative transnistrene, care nu vor corespunde analogului rusesc, nu vor fi aprobate \u015fi nu se vor exercita.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: .0001pt; text-align: justify; line-height: normal; mso-outline-level: 2;\"><span lang=\"RO\" style=\"font-size: 12.0pt; font-family: 'Times New Roman'; mso-ansi-language: RO; mso-fareast-language: RU;\">C\u0103tre 1 noiembrie 2016, \u201ecomisia de stat\u201d urmeaz\u0103 a prezenta Pre\u015fedintelui planul de ajustare a legisla\u0163iei \u201ermn\u201d celei din FR.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: .0001pt; text-align: justify; line-height: normal; mso-outline-level: 2;\"><span lang=\"RO\" style=\"font-size: 12.0pt; font-family: 'Times New Roman'; mso-ansi-language: RO; mso-fareast-language: RU;\">Specificarea dat\u0103 are o importan\u0163\u0103 deosebit\u0103. \u00cen 2006 \u015fi \u00een cei 10 ani ce au urmat, Tiraspolul nu a \u00eendeplinit prevederile propriului Cod electoral, potrivit c\u0103ruia rezultatele referendumului sunt puse la baza unor decizii decisive statale la subiectul respectiv. Nu a fost s\u0103 fie; ajustarea legisla\u0163iei cu cea ruseasc\u0103 purta un caracter ocazional, inconsecvent. Nu \u00eencape \u00eendoial\u0103 c\u0103 o asemenea atitudine e condi\u0163ionat\u0103 de pozi\u0163ia Moscovei. Da, Duma de Stat a adoptat Hot\u0103r\u00eerea respectiv\u0103, \u00eens\u0103 \u00een document doar se solicit\u0103 luarea \u00een considera\u0163ie a faptului c\u0103 acest fenomen s-a produs \u015fi el necesit\u0103 o aten\u0163ie mai mare problemelor cu care se confrunt\u0103 popula\u0163ia din regiune. Deputa\u0163ii \u00een Duma de Stat au semnat documentul, \u00een care se spunea c\u0103 \u201ese cere o nou\u0103 atitudine pentru a asigura respectarea drepturilor omului, p\u0103cii \u015fi securit\u0103\u0163ii \u00een regiune, unei solu\u0163ion\u0103ri echitabile a diferendului nistrean\u201d. C\u00eet \u0163ine de recunoa\u015fterea suveranit\u0103\u0163ii \u015fi ader\u0103rii ulterioare la Federa\u0163ia Rus\u0103 \u00een calitaate de subiect a Federa\u0163iei, nici vorb\u0103. Asemenea decizii sunt \u00een competen\u0163a Pre\u015fedintelui, dar el p\u0103streaz\u0103 t\u0103cerea.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: .0001pt; text-align: justify; line-height: normal;\"><span lang=\"RO\" style=\"font-size: 12.0pt; font-family: 'Times New Roman'; mso-ansi-language: RO; mso-fareast-language: RU;\">La moment nu exist\u0103 nici un document care ar demonstra c\u0103 Moscova \u015fi-a schimbat pozi\u0163ia anume \u00een problema statului regiunii. Am putea presupune c\u0103 ac\u0163iunea poart\u0103 un caracter pur electoral, c\u0103 prin lansarea decretului E. \u015eevciuc tinde a-\u015fi consolida influen\u0163a \u015fi autoritatea \u00een mediul aleg\u0103torilor \u015fi a-\u015fi asigura cel de al doilea mandat de pre\u015fedinte. \u015ei aceast\u0103 t\u0103lm\u0103cire a situa\u0163iei nu poate s\u0103 ne bucure, odat\u0103 ce ar confirma o dat\u0103 \u00een plus c\u0103 \u00een regiune aspectul integr\u0103rii cu RM nu este unul popular, ba dimpotriv\u0103. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: .0001pt; text-align: justify; line-height: normal;\"><span lang=\"RO\" style=\"font-size: 12.0pt; font-family: 'Times New Roman'; mso-ansi-language: RO; mso-fareast-language: RU;\">Pornind de la faptul c\u0103 reintegrarea este factorul de baz\u0103 a procesului de solu\u0163ionare pa\u015fnic\u0103 a diferendului nistrean, vom recurge la examinarea mai detaliat\u0103 a fenomenului (respingerea integr\u0103rii de c\u0103tre partea transnistrean\u0103), utiliz\u00eend cazul lui Valeriu Li\u0163cai. Nu ocazional a avut loc acest caz.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>Deci, la finele lunei august, \u00een cadrul unei conferin\u0163e \u201e\u015ftiin\u0163ifice\u201d la Chi\u015fin\u0103u, ex-minisstru transnistrean de externe a declarat c\u0103 \u201esepararea Transnistriei de Moldova ar fi una irealist\u0103\u201d. \u00cen opinia lui Li\u0163cai, \u201ela moment regiunea Transnistrean\u0103 se afl\u0103 \u00eentr-o stare de simbioz\u0103 cu Moldova, care cu timpul ar putea evolua spre o confedera\u0163ie, federa\u0163ie sau rela\u0163ii unionale\u201d. <span style=\"mso-spacerun: yes;\">\u00a0<\/span>Declara\u0163ia \u00eendat\u0103 a provocat critici dure la adresa lui Li\u0163cai. S-au scurs doar c\u00eeteva zile, umplute cu afirma\u0163ii una mai drastic\u0103 ca alta referitor la afirma\u0163iile ex-ministrului, \u015fi pre\u015fedintele Sovietului Suprem Vadim Krasnoselischii (func\u0163ia de consilier politic ai c\u0103rui o de\u0163inea <span style=\"mso-spacerun: yes;\">\u00a0<\/span>Valeriu <span style=\"mso-spacerun: yes;\">\u00a0<\/span>Li\u0163cai) a declarat oficial, c\u0103 nu cunoa\u015fte asemenea angajat, c\u0103 \u201eLi\u0163cai se afl\u0103 \u00een stare de naviga\u0163ie liber\u0103, \u015fi, respectiv, ideile \u015fi declara\u0163iile acestui \u00eei apar\u0163in personal\u201d. O reac\u0163ie care are la baz\u0103 aceea\u015fi temere de a nu da posibilitatea de a fi \u00eenvinuit sau b\u0103nuit de salutarea oric\u0103rei apropieri de Moldova, nemaivorbind de reintegrare. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: .0001pt; text-align: justify; line-height: normal;\"><span lang=\"RO\" style=\"font-size: 12.0pt; font-family: 'Times New Roman'; mso-ansi-language: RO; mso-fareast-language: RU;\">Potrivit unor anali\u015fti din regiune, o \u201esimbioz\u0103\u201d a Transnistriei \u015fi RM ar fi putut fi instaurat\u0103 \u00een 2003, dac\u0103 se accepta \u201eMemorandumul Kozak\u201d. Documentul, potrivit autorilor,<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>asigura <span style=\"mso-spacerun: yes;\">\u00a0<\/span>unitatea intereselor \u015fi comunitatea scopurilor. Plus, \u00een conformitate cu prevederile documentului, Tiraspolul \u015fi Comratul ob\u0163ineau posibilitatea de a bloca adoptarea actelor legislative ale Chi\u015fin\u0103ului, \u00een caz c\u0103 acestea nu le conveneau.
