color: #000000;\">Conflictul militar declan\u0219at \u00een anul 1992 pe teritoriul Republicii Moldova, \u00eentre for\u021bele separatiste de pe malul st\u00e2ng al Nistrului \u0219i cele oficiale, a dus la constituirea unei unit\u0103\u021bi politico-administrative \u201ede facto\u201d<a title=\"\" name=\"_ftnref1\" href=\"#_ftn1\"><span style=\"font-family: 'Times New Roman'; color: #000000;\">[1]<\/span><\/a> separate de restul Republicii, care \u0219i-a constituit propria organizare institu\u021bional\u0103 de tip statal: pre\u0219edin\u021bie, guvern, parlament (sub denumirea \u201eSoviet Suprem\u201d), Curte constitu\u021bional\u0103, control vamal.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 10pt; color: #000000;\">Aceast\u0103 realitate politico-administrativ\u0103 plaseaz\u0103 auto-intitulata \u201eRepublic\u0103 Moldovean\u0103 Nistrean\u0103\u201d \u00een cadrul unit\u0103\u021bilor politice \u201ede facto\u201d, care a demonstrat \u00een ultimele dou\u0103 decenii o aspira\u021bie consecvent spre obiectivul transform\u0103rii \u201ede jure\u201d \u00een subiect de drept interna\u021bional, suveran \u0219i independent.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 10pt; color: #000000;\">Din punctul de vedere al teoriei dreptului interna\u021bional, se confrunt\u0103 \u00een prezent dou\u0103 curente de g\u00e2ndire asupra posibilit\u0103\u021bii \u0219i scenariului de accedere a unei organiz\u0103ri politice \u201ede facto\u201d \u00een una \u201ede jure\u201d<a title=\"\" name=\"_ftnref2\" href=\"#_ftn2\"><span style=\"font-family: 'Times New Roman'; color: #000000;\">[2]<\/span><\/a>.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 10pt; color: #000000;\">Astfel, \u201eteoria declarativ\u0103\u201d sus\u021bine c\u0103 un stat poate dob\u00e2ndi calitate de subiect de drept interna\u021bional (sau \u201epersoan\u0103 de drept interna\u021bional\u201d) dac\u0103 \u00eendepline\u0219te cumulativ urm\u0103toarele criterii:<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 10pt; color: #000000;\">&#8211; Un teritoriu definit;<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 10pt; color: #000000;\">&#8211; O popula\u021bie permanent\u0103;<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 10pt; color: #000000;\">&#8211; O guvernare proprie;<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 10pt; color: #000000;\">&#8211; Capacitatea de a intra \u00een rela\u021bii cu alte state.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 10pt; color: #000000;\">Spre deosebire, \u201eteoria constitutiv\u0103\u201d afirm\u0103 necondi\u021bionat c\u0103 un stat poate fi considerat \u201epersoan\u0103 de drept interna\u021bional\u201d numai dac\u0103 este recunoscut ca atare de c\u0103tre celelalte state care sunt deja membre ale comunit\u0103\u021bii interna\u021bionale (adic\u0103 membre ale Organiza\u021biei Na\u021biunilor Unite).<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 10pt; color: #000000;\">\u00cen practic\u0103, putem opera o clasificare a unit\u0103\u021bilor politico-administrative \u201ede facto\u201d func\u021bionale \u00een zilele noastre, astfel:<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 10pt; color: #000000;\">&#8211; State non-membre ONU, nerecunoscute de c\u0103tre nicio alt\u0103 persoan\u0103 de drept interna\u021bional: Republica Somaliland.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 10pt; color: #000000;\">&#8211; State non-membre ONU, recunoscute de c\u0103tre alte state \u201ede facto\u201d non-membre ONU: Nagorno Karabah (recunoscut\u0103 de c\u0103tre Abhazia, Osetia de Sud \u0219i Transnistria) \u0219i Transnistria (recunoscut\u0103 de c\u0103tre Abhazia, Nagorno Karabah \u0219i Osetia de Sud).<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 10pt; color: #000000;\">&#8211; State recunoscute de c\u0103tre cel pu\u021bin un membru ONU: Abhazia (recunoscut\u0103 de c\u0103tre Federa\u021bia Rus\u0103, Nicaragua, Venezuela, Nauru \u0219i Tuvalu, precum \u0219i de c\u0103tre non-membrele ONU: Osetia de Sud, Transnistria \u0219i Nagorno Karabah), Taiwan (recunoscut\u0103 de c\u0103tre 22 membri ONU \u0219i Vatican), Kosovo (recunoscut\u0103 de 106 membri ONU \u0219i Taiwan), Ciprul de Nord (recunoscut de c\u0103tre Turcia, av\u00e2nd statut de observator la Organza\u021bia pentru Cooperare Islamic\u0103 \u0219i Organiza\u021bia pentru Cooperare Economic\u0103), Palestina (recunoscut\u0103 de c\u0103tre 134 membri ONU), Sahara de Vest (recuoscut\u0103 de c\u0103tre 84 membri ONU, dintre care 37 i-au retras ulterior recunoa\u0219terea). \u00cen aceast\u0103 categorie poate fi plasat\u0103 \u0219i Osetia de Sud, recunoscut\u0103 de c\u0103tre 5 membri ONU (Federa\u021bia Rus\u0103, Nicaragua, Venezuela, Tuvalu \u0219i Nauru) plus trei non-membri ONU (Abhazia, Nagorno-Karabah \u0219i Trasnistria).<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 10pt; color: #000000;\">&#8211; Analiz\u00e2nd comparativ pozi\u021bia interna\u021bional\u0103 a statelor nerecunoscute \u00een sistemul interna\u021bional, devine evident\u0103 pozi\u021bia slab\u0103 (cea mai slab\u0103) a Transnistriei. Nefiind recunoscut\u0103 de&nbsp; c\u0103tre niciun stat membru ONU \u0219i de c\u0103tre nicio organiza\u021bie interna\u021bional\u0103 recunoscut\u0103\/acreditat\u0103 la ONU, Transnistria nu beneficiaz\u0103 de avantajele pe care celelalte subiecte ale \u201econflictelor \u00eenghe\u021bate\u201d de la Marea Neagr\u0103 (Osetia de Sud \u0219i Nagorno Karabak) le au: recunoa\u0219terea din partea a c\u00e2te cinci state membre ONU.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 10pt; color: #000000;\">De aici \u0219i dificultatea enorm\u0103 de a construi, principial \u0219i institu\u021bional, o politic\u0103 extern\u0103 \u2013 care este atributul suveranit\u0103\u021bii na\u021bionale \u0219i decurge din calitatea din subiect (persoan\u0103) de drept interna\u021bional.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 10pt; color: #000000;\"><strong>&nbsp;<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 10pt; color: #000000;\"><strong>Institu\u021biile de tip statal \u0219i atribu\u021biile lor de politic\u0103 extern\u0103<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 10pt; color: #000000;\"><i>Atribu\u021bii constitu\u021bionale.<\/i> Constitu\u021bia Republicii Moldovene\u0219ti Nistrene<a title=\"\" name=\"_ftnref3\" href=\"#_ftn3\"><span style=\"font-family: 'Times New Roman'; color: #000000;\">[3]<\/span><\/a> dedic\u0103 un articol \u00eentreg (art. 10) principiilor de politic\u0103 extern\u0103 ale statului: \u201ePolitica extern\u0103 a Republicii se realizeaz\u0103 \u00een conformitate cu principiile egalit\u0103\u021bii suverane a statelor, neutiliz\u0103rii for\u021bei, solu\u021bion\u0103rii pa\u0219nice a disputelor, neamestecului \u00een treburile interne ale altor state. Principiile \u0219i normele de drept interna\u021bional, precum \u0219i tratatele interna\u021bionale ale Republicii Moldovene\u0219ti Nistrene universal recunoscute trebuie s\u0103 fie la baza rela\u021biilor cu alte state \u0219i o component\u0103 a sistemului juridic.\u201d<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 10pt; color: #000000;\">Articolul 56 revine \u0219i \u00eent\u0103re\u0219te preten\u021bia suveran\u0103 a statului, a\u0219ez\u00e2nd politica extern\u0103 \u00eentre func\u021biile sale esen\u021biale (lit. e., \u00eentr-o \u00een\u0219iruire la la a. la q.: \u201es\u0103 urmeze o politic\u0103 extern\u0103\u201d).<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 10pt; color: #000000;\">Parlamentul este \u00eens\u0103rcinat cu \u201eaprobarea unui concept de politic\u0103 intern\u0103 \u0219i extern\u0103, \u200b\u200bprecum \u0219i al securit\u0103\u021bii na\u021bionale a Republicii Moldovene\u0219ti Nistrene \u0219i a doctrinei sale militare\u201d (art. 62, pct. 3 lit. d.).<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 10pt; color: #000000;\">\u00cen acest timp \u201ePre\u0219edintele Republicii Moldovene\u0219ti Nistrene va elabora un concept de politic\u0103 intern\u0103 \u0219i extern\u0103 a statului, \u00een conformitate cu Constitu\u021bia \u0219i legile, \u0219i va lua m\u0103suri pentru punerea sa \u00een aplicare\u201d (art. 70, pct. 3). Acela\u0219i articol, la pct. 5, acord\u0103 pre\u0219edintelui puterile obi\u0219nuite de politic\u0103 extern\u0103 \u00een regimul de tip preziden\u021bial: \u201ePre\u0219edintele Republicii Moldovene\u0219ti Nistrene trebuie s\u0103 aib\u0103 puterea de a ghida politica extern\u0103 a RMN, pentru a face tratatele interna\u021bionale ale RMN, s\u0103 semneze instrumentele de ratificare furnizate Parlamentului de acord, s\u0103 primeasc\u0103 scrisorile de acreditare \u0219i scrisori de rechemare a reprezentan\u021bilor diplomatici.\u201d<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 10pt; color: #000000;\">O sumar\u0103 (dar esen\u021bial\u0103) verificare asupra modului exercit\u0103rii atribu\u021biilor preziden\u021biale de politic\u0103 extern\u0103, conform Constitu\u021biei, demonstreaz\u0103 c\u0103 pre\u0219edintele nu a fost niciodat\u0103, de la intrarea \u00een vigoare a actului fundamental al statului, \u00een situa\u021bia principial\u0103 sau concret\u0103 de a \u00eendeplini acte sau activit\u0103\u021bi de politic\u0103 extern\u0103. Constitu\u021bia tranistrean\u0103 formuleaz\u0103 doar un deziderat \u00een a\u0219teptarea concretiz\u0103rii sale; este un act de voin\u021b\u0103 unilateral\u0103, imposibil de implementat \u00een condi\u021biile actuale ale dreptului interna\u021bional \u0219i ale realit\u0103\u021bii interna\u021bionale.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 10pt; color: #000000;\"><i>Parlamentul <\/i>(\u201eSovietul Suprem\u201d) \u00ee\u0219i concretizeaz\u0103 propriile func\u021bii \u0219i institu\u021bii de politic\u0103 extern\u0103. <\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 10pt; color: #000000;\">Acesta a constituit Comisia de Politic\u0103 Extern\u0103 \u0219i Rela\u021bii Interna\u021bionale<a title=\"\" name=\"_ftnref4\" href=\"#_ftn4\"><span style=\"font-family: 'Times New Roman'; color: #000000;\">[4]<\/span><\/a>, care \u00ee\u0219i declar\u0103 urm\u0103toarele atribu\u021bii: elaboreaz\u0103 rezolu\u021bii privind tratatele interna\u021bionale, pe care le&nbsp; \u00eenainteaz\u0103 Sovietului Suprem al RMN pentru ratificare sau de aprobare, \u00een temeiul legisla\u021biei \u00een vigoare; solicit\u0103 informa\u021bii suplimentare la organele abilitate cu privire la actele juridice necesare pentru ratificarea sau aprobarea tratatelor interna\u021bionale; invit\u0103 exper\u021bi independen\u021bi pentru a oferi consiliere cu privire la informa\u021bii \u0219i textul tratatului; elaboreaz\u0103 rapoarte \u0219i declara\u021bii cu privire la politica extern\u0103 \u0219i probleme de cooperare interna\u021bional\u0103 necesare dezbaterilor \u00een \u0219edin\u021bele Sovietului Suprem al RMN; ofer\u0103 un control pre- legislativ proiectelor de adrese \u0219i declara\u021bii ale Sovietului Suprem pe probleme de politic\u0103 extern\u0103; analizeaz\u0103 acte legislative recomandate de Adunarea Interparlamentar\u0103 a statelor membre CSI pentru a prezenta Sovietului Suprem al RMN o analiz\u0103 suplimentar\u0103 pentru a lua o decizie privind punerea \u00een aplicare; elaboreaz\u0103 programe de proiecte privind cooperarea cu parlamentele din alte state \u00een vederea trimiterii de rapoarte comisiilor Sovietului Suprem al RMN, deputa\u021bilor, fac\u021biunilor \u0219i grupurilor din Sovietul Suprem; prime\u0219te rapoarte ale delega\u021biilor parlamentare oficiale ale Sovietului Suprem al RMN cu privire la activit\u0103\u021bile desf\u0103\u0219urate.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 10pt; color: #000000;\">\u00cen lipsa oportunit\u0103\u021bilor concrete de a exersa rela\u021biile interna\u021bionale, activitatea comisiei se concentreaz\u0103 pe elaborarea cadrului legislativ \u0219i a organiz\u0103rii interne. Ultima activitate a comisiei, consemnat\u0103 pe site-ul oficial, dateaz\u0103 din 11 martie 2011<a title=\"\" name=\"_ftnref5\" href=\"#_ftn5\"><span style=\"font-family: 'Times New Roman'; color: #000000;\">[5]<\/span><\/a>. \u00centre pu\u021binele activit\u0103\u021bi f\u0103cute publice p\u00e2n\u0103 la acea dat\u0103, lipsesc rela\u021biile interna\u021bionale propriu-zise<a title=\"\" name=\"_ftnref6\" href=\"#_ftn6\"><span style=\"font-family: 'Times New Roman'; color: #000000;\">[6]<\/span><\/a>. Accea\u0219i surs\u0103 oficial\u0103 indic\u0103 faptul c\u0103 nu exist\u0103 acte normative \u0219i calendar de evenimente, l\u0103s\u00e2nd impresia c\u0103 aceast\u0103 comisie r\u0103m\u00e2ne o form\u0103 f\u0103r\u0103 con\u021binut.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 10pt; color: #000000;\">O institu\u021bie parlamentar\u0103 instituit\u0103 formal este \u201eTrimisul Special al Parlamentului RMN la sesiunile interparlamentare\u201d. Din investigarea site-ului oficial al Sovietului Suprem \u00een\u021belegem c\u0103 nu a a fost desemnat niciun parlamentar pentru aceast\u0103 func\u021bie, nu a existat nicio activitate \u00een acest sens, \u0219i nu exist\u0103 nicio posibilitate de contact institu\u021bional sau personal<a title=\"\" name=\"_ftnref7\" href=\"#_ftn7\"><span style=\"font-family: 'Times New Roman'; color: #000000;\">[7]<\/span><\/a>.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 10pt; color: #000000;\"><i>Ministerul Afacerilor Externe<\/i> este singurul \u00eentre ministerele de la Tiraspol care se prezint\u0103 public cu un site propriu, remarcabil sub aspect tehnic \u0219i artistic \u2013 ceea ce arat\u0103 aten\u021bia deosebit\u0103 pe care o acord\u0103 regimul idealului s\u0103u de politic\u0103 extern\u0103 independent\u0103.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 10pt; color: #000000;\">Organizarea \u0219i func\u021bionarea MAE din Tiraspol a fost stabilit\u0103 prin \u201eDecretul privind aprobarea regulamentului, structurii \u0219i statului de functiuni ale Ministerului Afacerilor Externe al RMN\u201d<a title=\"\" name=\"_ftnref8\" href=\"#_ftn8\"><span style=\"font-family: 'Times New Roman'; color: #000000;\">[8]<\/span><\/a>, semnat de c\u0103tre Igor Smirnov \u00een august 2004. Conform acestuia, misiunile fundamentale ale MAE constau \u00een: a) realizarea cursului politicii externe a RMN; b) asigurarea condi\u021biilor necesare pentru ca pre\u0219edintele s\u0103 efectueze managementul general al politicii externe a Republicii \u0219i s\u0103 ia m\u0103suri \u00een ordinea stabilit\u0103 de Constitu\u021bia RMN referitor la protejarea suveranit\u0103\u021bii \u0219i independen\u021bei RMN; c) elaborarea strategiei generale a politicii externe a RMN \u0219i prezentarea de propuneri corespunz\u0103toare c\u0103tre pre\u0219edinte; d) asigurarea protec\u021biei suveranit\u0103\u021bii, securit\u0103\u021bii, integrit\u0103\u021bii teritoriale, precum \u0219i altor interese ale RMN pe arena interna\u021bional\u0103 prin mijloace diplomatice; e) asigurarea func\u021bion\u0103rii \u00een acord \u0219i cooperare a pre\u0219edintelui cu autorit\u0103\u021bile republicane \u0219i locale cu privire la punerea \u00een aplicare a cursului politicii externe a Republicii; f) organizarea interac\u021biunii pre\u0219edintelui cu organele de stat, reprezentan\u021bele \u0219i ambasadele din CSI \u0219i statele str\u0103ine \u0219i organiza\u021bii interna\u021bionale; g) protec\u021bia drepturilor \u0219i intereselor legitime ale cet\u0103\u021benilor \u0219i persoanelor juridice ale RMN \u00een str\u0103in\u0103tate; h) asigurarea rela\u021biilor diplomatice \u0219i consulare ale RMN cu statele str\u0103ine \u0219i reprezentan\u021bele acestora, precum \u0219i cu organiza\u021biile interna\u021bionale; i) coordonarea activit\u0103\u021bii \u0219i controlul asupra activit\u0103\u021bii organelor executive ale puterii de stat, \u00een scopul de a efectua o singur\u0103 linie politic\u0103 a RMN \u00een rela\u021biile cu statele str\u0103ine \u0219i organiza\u021biile interna\u021bionale.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 10pt; color: #000000;\">\u00cen baza aceluia\u0219i decret preziden\u021bial, structura organizatoric\u0103 a MAE arat\u0103 astfel<a title=\"\" name=\"_ftnref9\" href=\"#_ftn9\"><span style=\"font-family: 'Times New Roman'; color: #000000;\">[9]<\/span><\/a>: Conducerea (un ministru, doi mini\u0219tri adjunc\u021bi \u0219i un consilier al ministrului); Departamentul Central pentru Politic\u0103 Extern\u0103 (cu patru departamente subordonate: \u021a\u0103rile CSI, Procese de negociere; \u021a\u0103ri \u00eendep\u0103rtate \u0219i Organiza\u021bii interna\u021bionale; Activit\u0103\u021bi economice \u00een str\u0103in\u0103tate); Departamentul Central pentru Protocol, Suport Legislativ \u0219i Rela\u021bii Publice (include trei departamente: Suport de protocol; Comunicare public\u0103; Traduceri \u0219i expertiz\u0103 lingvistic\u0103); Departamentul Central pentru Finan\u021be \u0219i Serviciu Legislativ (subordoneaz\u0103 dou\u0103 departamente: Consular \u0219i Legislativ, \u0219i Finan\u021be) \u0219i Departamentul Central Managerial (Registratur\u0103, \u00centre\u021binere, Logistic\u0103).<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 10pt; color: #000000;\">C\u00e2teva chei de verificare pe care ni le ofer\u0103 site-ul oficial al MAE de la Tiraspol pentru a distinge \u0219i cuantifica m\u0103sura \u00een care, ca structur\u0103 esen\u021bial\u0103 a politice externe a RMN, \u00ee\u0219i \u00eendepline\u0219te func\u021biile stabilite prin legisla\u021bia transnistrean\u0103:<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 10pt; color: #000000;\"><span style=\"text-decoration: underline;\">Agenda ministrului<\/span><a title=\"\" name=\"_ftnref10\" href=\"#_ftn10\"><span style=\"font-family: 'Times New Roman'; color: #000000;\">[10]<\/span><\/a> (\u00een prezent \u2013 Nina \u0218tanski) arat\u0103 un program de \u00eent\u00e2lniri cu ambasadori ai unor state str\u0103ine \u00een Republica Moldova. \u00cen cursul anului 2013, au fost discu\u021bii cu ambasadorii la Chi\u0219in\u0103u ai Marii Britanii, Republicii Federale Germania \u0219i Federa\u021biei Ruse, dar \u0219i cu mini\u0219trii de externe ai Suediei \u0219i Poloniei. Un capitol mai bine reprezentat este cel al \u00eent\u00e2lnirilor cu delega\u021bii unor organiza\u021bii interna\u021bionale (OSCE, UNICEF,&nbsp; Consiliul Europei, Commonwealth). Statul \u201ede facto\u201d transnistrean nu are \u0219i nu poate dezolta (conform cu regulile actuale ale dreptului interna\u021bional) un sistem de ambasade \u0219i consulate. La aproape un deceniu de la adoptarea de c\u0103tre parlament \u0219i sanc\u021bionarea de c\u0103tre Igor Smirnov, aceast\u0103 lege r\u0103m\u00e2ne neaplicat\u0103 \u0219i inaplicabil\u0103 \u00een toate prevederile sale.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 10pt; color: #000000;\"><span style=\"text-decoration: underline;\">Procesul de selec\u021bie \u0219i promovare<\/span> a func\u021bionarilor este lipsit de transparen\u021b\u0103.
